Zable Health Pty Ltd (ABN: 26 641 519 904) (“Zable Health”, “we”, “us” or “our”) provides users with:

(a) access to the Zable.com.au platform including the www.zable.com.au website, mobile site, apps and our other websites (together the “Platform”); and

(b) any of Zable Health’s services made available on the Platform,

(together, the “Services”)

We recognise the importance of protecting personal information and we take great care with any personal information that we may gather when you access or use the Services.

This Privacy Policy explains how we collect, use, maintain and disclose Personal Information (as defined in the Privacy Act 1988 (Cth)) which we collect, including information or an opinion about an individual which is reasonably capable of identifying that individual (and might include their health or other sensitive information) and any other information of any kind in any form provided by you or any health professionals engaged by you.

To provide our Services we need to collect Personal Information. We may collect Personal Information from you in multiple ways, including via the Platform, telephone and email, from individuals or representatives that you have authorised and from health professionals and their Practices. This Privacy Policy applies to the Services provided by us, or any of our subsidiary companies, via the Platform.

By accessing the Platform, you acknowledge and agree that you have read and understood this Privacy Policy and consent to the use of your Personal Information as set out in this Privacy Policy. If you do not agree with this Privacy Policy, please do not continue to use the Platform.

Where you are using the Services on behalf of someone else such as a child, spouse or other person (a third party user or “TPU”), by accessing and utilising the Services on behalf of that person you affirm and warrant that you have obtained all necessary consents and authorisations from such TPU to (i) enter and submit the TPU’s Personal Information to use the Services, and (ii) for us to collect and use the Personal Information of the TPU in accordance with this Privacy Policy.  You further affirm that you possess the necessary legal authority to grant this consent and authorisation on behalf of the TPU, thereby binding the TPU to this Privacy Policy. In instances where the TPU is a minor or is otherwise incapable of entering into a contract, you affirm your authority to agree to compliance with Privacy Policy on their behalf.

“Personal Information” has the meaning given to it in the Privacy Act 1988 (Cth) (Act). In general terms, it is any information that can be used to personally identify you. This may include, but is not limited to, your name and contact details including phone numbers and email addresses, the type of appointment you may request, information about your health and any medical condition, your health insurance fund and your communications with health professionals. If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered Personal Information. References to ‘you’ or ‘your’ in this Privacy Policy are references to any party who accesses our Platform including any person who wishes to explore health service providers or book appointments and any health service providers which use our Platform.

How Your Information is Used and Disclosed

Third Party Practices – You hereby acknowledge and agree to us sharing your Personal Information with third parties, such as clinics, practices, physicians, doctors and health professionals that offer medical and health related services in Australia, as part of, and to the extent necessary for, us providing the Services to you.  

Information You Provide – When you use our Platform to request an appointment or otherwise communicate with us, you will be required to provide Personal Information. We may utilise the Personal Information you submit in order to provide our Services to you, confirm your identity, manage our relationship with you and contact you.

Cookies – When you use the Services, we may use common technologies such as cookies and web beacons to keep track of users’ interactions with the Platform to improve the quality of the Services. We may also collect your Internet Protocol (IP) address to track and aggregate non-personally identifiable information, your referring website addresses, browser type, domain name, and access times.

Log Information – When you access the Services, our servers automatically record certain information. These server logs may include information such as your web request, your interaction with a service, IP address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser.

Communications – When you send email or other communications to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services. We may use your email address to communicate with you about our services.

Third Party Applications – We may make available third party applications, during the provision of the Services. The information collected by us when you enable a third party application is processed under this Privacy Policy. Information collected by the third party application provider is governed by their own privacy policies.

Other Third Parties – We may also disclose de-identified information of our users to third parties that collect and process data for analysis, research and quality assurance purposes

Other Websites – This Privacy Policy applies to our Platform only. We do not exercise control over any websites displayed or linked from within our Platform. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you.

In addition to the above, we may use the information collected to:

  • plan, provide, maintain, monitor, protect, evaluate and improve our Services and develop new Services;
  • facilitate administrative services, billing processes, payments, and the recovery of debts;
  • promote the services of third-parties which we deem may be of interest to you;
  • carry out technical analysis to determine how to improve the Platform;
  • perform statistical analysis and reporting to enhance service delivery;
  • improve our service to you and your experience with us;
  • enforce Zable Health’s Platform Terms of Use, and protect the rights or property of Zable Health or its users;
  • detect, prevent, or otherwise address fraud, security or technical issues; 
  • train our staff, contractors, and other personnel to ensure high standards of service;
  • engage in risk management activities and managing legal liabilities and claims, including interactions with insurers and legal representatives;
  • address enquiries and resolving complaints related to our services;
  • seek advice from consultants, professional advisers, and other experts to support our operational decisions; and
  • comply with any applicable law, legal requirement or order, subpoenas, police investigation, other regulatory obligations or request from a Government authority.

If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.

If we become involved in a merger, acquisition, or any form of sale of some or all of its assets, we will use our best endeavours to:

(a) ensure the confidentiality of any Personal Information involved in such transactions; and

(b) provide notice before your Personal Information is transferred and becomes subject to a different privacy policy.

Storing and Securing Personal Information

Zable Health is committed to the protection and privacy of Personal Information entrusted to us by our users. In alignment with this commitment, all Personal Information collected through our Platform, Services, or any interactions related to our business operations, is stored on secured servers provided by Amazon Web Services which are located in Australia.

We undertake to employ reasonable security measures to safeguard Personal Information against unauthorised access, alteration, disclosure, or destruction. Our security practices include, but are not limited to, the application of standard industry encryption methods during the storage and transfer of Personal Information, the implementation of access controls and monitoring systems to regulate access to data, and the enforcement of strict confidentiality obligations on our team members and service providers who are granted access to Personal Information.

In addition to our efforts to secure Personal Information, Zable Health is devoted to ensuring that the data we collect is managed responsibly. To this end, we will  take reasonable steps to: 

  • make sure that the Personal Information we collect, use and disclose is accurate, complete and up-to-date. If you would like to review and confirm the accuracy of your personal information, you can contact us at accounts@zable.com.au, and
  • take reasonable steps to destroy or de-identify Personal Information that is no longer required for the purposes for which it was collected or for legal compliance purposes. This process will be conducted in a manner that adheres to our commitment to protect user privacy and in compliance with applicable privacy laws and regulations.

By entrusting Zable Health with your Personal Information, you acknowledge and consent to the storage and security practices outlined in this clause. Your continued use of our Services affirms your agreement to these practices as part of our broader Privacy Policy.

Data Protection and Information Security

We acknowledge that we will take appropriate security measures to protect against unauthorised access to or unauthorised alteration, modification, disclosure or destruction of data, including Personal Information. These measures may include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorised access to systems where we store personal data.

Precautions we take include using standard industry encryption methods when storing and transferring Personal Information; implementing monitoring and access controls that regulate who can access particular information; requiring our team and service providers to comply with confidentiality obligations before they access Personal Information.

International Disclosure of Personal Information

Zable Health currently does not disclose Personal Information to overseas recipients. However, in the future, it may become necessary or desirable for us to disclose Personal Information to overseas third parties, including but not limited to offshore cloud storage providers and information technology specialists or members of our staff who are working remotely from overseas. Such disclosures would be made to assist in troubleshooting or enhancing Zable Health's infrastructure environment or for other purposes related to the provision of our Services. In the event that Zable Health decides to disclose Personal Information to overseas parties, we will take reasonable steps to ensure that any such recipients are bound by confidentiality and privacy obligations consistent with the Australian Privacy Principles and this Privacy Policy.

Disclaimer

You acknowledge and agree that Zable Health disclaims all and any guarantees undertakings and warranties, expressed or implied, in the provision of the Services and is not liable for any loss or damage whatsoever (including personal injury or property damage, negligence or otherwise, incidental or consequential loss or damage) arising out of, or in connection with the Services, to the fullest extent permitted by law.

Where we cannot exclude such liability under the Competition and Consumer Act 2010 (Cth), our liability to you will be limited to: (i) if the breach relates to goods, the replacement or repair the goods or (ii) if the breach relates to services, the supply of those services or the payment of the cost of those services supplied again.

Release

You hereby release, discharge and hold harmless Zable Health from all actions, proceedings, claims or liabilities brought against or made upon Zable Health by you arising directly or indirectly with the provision of the Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, on the part of Zable Health. For the avoidance of doubt, this release extends to all directors, officers, employees, contractors, agents, representatives, licensees or permitted assigns of Zable Health.

Any feedback, comments, ideas, improvements, or suggestions (collectively, "Feedback") provided by you to Zable Health with respect to the Services becomes the sole and exclusive property of Zable Health. By submitting Feedback, you irrevocably assign to Zable Health all of your right, title, and interest in and to your Feedback, including any intellectual property rights therein. Zable Health shall be entitled to the unrestricted use and dissemination of this Feedback for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive any moral rights you may have in such Feedback and agree that you have no recourse against Zable Health for any alleged or actual infringement or misappropriation of any proprietary rights in your Feedback.

Complaints and Resolution Process

Zable Health is committed to resolving any complaints regarding your privacy and our collection or use of your Personal Information. Should you have any concerns about your privacy or how your Personal Information is being handled, we encourage you to contact us directly. The following outlines the process we will undertake to resolve your complaint:

  • Submission of Complaint: please submit your privacy complaint in writing to accounts@zable.com.au. Ensure that you provide us with detailed information about your concern or complaint, along with any supporting documents.
  • Acknowledgment of Receipt: upon receiving your complaint, we will acknowledge receipt within ten (10) business days. We will provide you with the details of the person who will be handling your complaint.
  • Investigation: your complaint will be investigated promptly. We may need to contact you to understand more about your concerns and to gather further information.
  • Resolution: we aim to resolve complaints within thirty (30) days of receiving them. Should your complaint require more time to resolve, we will notify you of the need for an extension and keep you updated on the progress.
  • Response: upon completion of our investigation, we will provide you with a written response outlining the outcome of your complaint, any actions we have taken, and the reasons for our decision.

Zable Health takes your privacy concerns seriously and is committed to transparent and fair resolution of complaints.

Changes to this Privacy Policy

We may amend or vary this Privacy Policy from time to time by publishing the amended Privacy Policy on the Platform. You should review this Privacy Policy periodically so that you are updated on any changes.  The Privacy Policy that applies to your use of the Services is the Privacy Policy in effect at the time of your use of the Services. By accessing or using the Services after we have posted any such changes, you accept the amended Privacy Policy. If you do not agree to the updated terms of use, you must cease using the Services.
